Welcome to Penwise (hereinafter referred to as "the Site" or "Penwise"), an online platform that allows users to generate custom-written books using AI-powered language models. Access to and use of the services provided by Penwise (hereinafter "the Service") are subject to the following terms and conditions. These Terms form a legally binding agreement between the user ("you," "the User") and the Site.

By subscribing to or using our Service, you agree to be bound by these Terms. If you do not agree, you must refrain from using the Site.

2. Description of the Service

Penwise offers book creation services through AI-driven content generation. Users input prompts or ideas, and the system generates written content based on these inputs. Access to this functionality is granted through a paid subscription model.

3. Nature of AI-Generated Content

3.1 No Guarantee of Personal Satisfaction

The content generated through Penwise is produced automatically by an AI model and based solely on the instructions provided by the User.

While we aim to provide high-quality content, Penwise makes no guarantees that the generated content will:

meet your subjective expectations,
conform to literary or publishing standards,
be error-free or fully coherent,
be suitable for publication or commercial use.

The User acknowledges that the results may vary and releases Penwise from all responsibility if the output does not meet their goals.

3.2 No Editorial Responsibility

Penwise does not review, edit, or verify the generated texts for accuracy, legality, originality, or appropriateness. You are solely responsible for reviewing, editing, and verifying any content you choose to use, share, or publish.

4. Intellectual Property

4.1 User Rights

The User retains rights over the content generated under their account. However, Penwise reserves the right to use anonymized excerpts of generated content for promotional, technical, or research purposes unless the User explicitly requests exclusion in writing.

4.2 No Guarantee of Originality

Due to the nature of AI generation, Penwise cannot guarantee that content is completely unique or has not been generated in similar form for other users. Penwise disclaims all liability for accidental similarities with existing works or third-party content.

5. Subscriptions and Payments

5.1 Payment Terms

Access to the full Service is granted upon subscription. Prices and available plans are displayed on the Site. All payments are processed securely via third-party payment providers.

All sales are final. No refunds will be issued after purchase, except in cases of clear technical errors that prevent access to the Service.

5.2 Renewal

All subscriptions renew automatically unless cancelled by the User before the renewal date. The User may cancel at any time via their account settings.

6. User Conduct and Prohibited Content

The User agrees not to use the Service to create, promote, or distribute content that is:

illegal, hateful, defamatory, or discriminatory,
obscene, violent, or abusive,
infringing on the intellectual property rights or privacy of others,
misleading, fraudulent, or designed to impersonate others.

Penwise reserves the right to suspend or permanently block access to any User found violating these terms, without refund.

7. Limitation of Liability

To the fullest extent permitted by law, Penwise shall not be liable for:

any indirect, incidental, or consequential damages,
any loss of profits, reputation, opportunities, or data,
any dissatisfaction with the content generated,
any errors, omissions, or inappropriate material present in AI-generated text.

In any case, the total liability of Penwise shall not exceed the amount paid by the User in the twelve (12) months prior to the event giving rise to the claim.

8. Termination

You may terminate your subscription at any time. Access to the Service will continue until the end of the paid period. No partial refunds will be issued.

Penwise may suspend or terminate your access without notice if you violate these Terms or misuse the Service.

9. Privacy and Data Collection

Penwise collects only essential data (such as email address, prompts entered, generated content, and subscription info) to operate the Service. Your data will never be sold to third parties.

You may request access, correction, or deletion of your personal data at any time by contacting us.

10. Changes to the Terms

Penwise reserves the right to update these Terms at any time. In the event of material changes, we will notify Users via email or an in-app message. Continued use of the Service after the changes implies acceptance of the new Terms.

11. Governing Law and Jurisdiction

These Terms are governed by the laws of Canada. Any disputes arising from the use of the Service shall fall under the exclusive jurisdiction of the courts in Quebec.
